There is an ongoing despute between my friend who owns a furniture shop and a customer over a sofa. They sent an upholsterer in to the shop with a camera to take pictures without the owners permission to help with their case. Is this illegal?.--Answer1:Your question is unclear. And Im not a lawyer, so this isnt legal advice. However, the store owner has a right to admit, or not admit, anyone to the store. If a person enters without the owners permission, the owner can call the police and have the person charged with trespassing. So the owner can keep someone out. However, who owns the sofa? If its the store owner, then were still in the trespassing scenario. If the customer owners the sofa, it would still be trespassing, but the owner could make an argument that the owner has right to access their own property.Check with a lawyer for more information..--Answer2:I would say that unless the store owner specifically forbade the person from entering the store and taking pictures PRIOR to doing so, it isnt illegal. The store owner would have been fully within his/her rights to ask the person to leave as soon as they saw what they were doing. If they refused, they could then be arrested for trespassing..--Answer3:its only illegal if they use the pictures for profit, or if they had a do not tresspass order against the camera man, or a restraining order against the customer. in the future, if you want to give your friend legal advice, tell them this line "ask a lawyer".--Answer4:The sofa was bought by the customer so doesnt he have a right to take pictures of it? Was that before he bought it that he took the pictures? Well if he bought it after he took the pictures hes paid for ti now whats the problem? If he took the pictures after he bought it it wouldnt be in the shop anymore.
